The DOJ just confirmed it won't prosecute developers for code that others use to break the law. For two years, crypto developers have been building under the shadow of the Tornado Cash precedent - where writing open-source privacy code became a federal crime. That chilling effect has shaped what DeFi teams build, where they incorporate, and whether US engineers stay in the space at all.
This policy shift is quietly one of the most important things to happen to DeFi infrastructure in years. It means US-based developers can work on privacy protocols, bridges, and smart contracts without existential legal risk. The next generation of DeFi tooling - MEV protection, on-chain privacy, cross-chain messaging - just got a lot more viable to build in America.
Code is speech. The DOJ finally seems to agree. Does this bring builders back to the US - or has the talent drain to Dubai, Singapore, and Zug already become permanent?
