Here’s your Day 4 recap of EVERYTHING that happened yesterday to conclude week 1 of the Musk v. OpenAI trial. SHIVON ZILIS: - Shivon Zilis emerges as the key behind-the-scenes player. Musk’s longtime exec, Neuralink/Tesla colleague, and mother of four of his children served as advisor → OpenAI board director (2020-2023) while acting as covert liaison between Musk and OpenAI long after he left the board in 2018. SUS TEXTS & EMAILS: - Feb 2018 (days before Musk’s exit): Zilis asks Musk if she should stay “close and friendly” for info flow. Musk: “Close and friendly… we are going to actively try to move three or four people from OpenAI to Tesla.” - Musk on why: “I wanted to know what’s going on.” - Summer/Fall 2017: Zilis relays board negotiations to Musk, updates him on fundraising and projects, and gets copied on sensitive threads. - 2022-2023: Altman texts Zilis for advice on handling angry Musk messages and whether to tweet something nice about him. MUSK’S FINAL TESTIMONY: - Called Zilis “chief of staff,” “close advisor,” then acknowledged “we live together and she’s the mother of four of my children.” He claimed she never shared unauthorized sensitive info. - Repeated “you just can’t steal a charity” at least five times. OpenAI countered that he donated ~$38M with no strings attached, waited years to sue, and only got loud once he launched xAI. - Judge’s skepticism: Noted the irony of Musk warning about AI risks while building a for-profit competitor in the same space. “I suspect that there are plenty of people who don’t want to put the future of humanity in Mr. Musk’s hands.” WHAT’S NEXT? - Brockman expected to testify Monday.
